Về việc áp dụng chứng nhận Apostille thay cho hợp pháp hóa lãnh sự
kể từ ngày 11 tháng 9 năm 2026
1. Thông tin chung
Việt Nam đã gia nhập Công ước về miễn hợp pháp hóa đối với giấy tờ công của nước ngoài, ký tại La Hay ngày 05/10/1961 (Công ước Apostille). Công ước có hiệu lực đối với Việt Nam từ ngày 11/9/2026. Từ thời điểm này, giấy tờ công lưu thông giữa Việt Nam và các Quốc gia thành viên có quan hệ áp dụng với Việt Nam chỉ cần một chứng nhận duy nhất là chứng nhận Apostille, thay cho thủ tục hợp pháp hóa lãnh sự trước đây.
Chứng nhận Apostille xác nhận tính xác thực của chữ ký, chức danh, thẩm quyền của người ký và con dấu trên giấy tờ công; chứng nhận Apostille không xác nhận nội dung của giấy tờ.
2. Thay đổi tại Tổng Lãnh sự quán Việt Nam tại Thượng Hải
Kể từ ngày 11/9/2026, Tổng Lãnh sự quán Việt Nam tại Thượng Hải ngừng tiếp nhận hồ sơ đề nghị hợp pháp hóa lãnh sự đối với giấy tờ công do cơ quan có thẩm quyền của nước Cộng hòa nhân dân Trung Hoa cấp.
3. Giấy tờ của nước Cộng hòa nhân dân Trung Hoa để sử dụng tại Việt Nam
Quý vị liên hệ trực tiếp cơ quan có thẩm quyền cấp chứng nhận Apostille của nước Cộng hòa nhân dân Trung Hoa nêu tại mục 7 dưới đây để xin cấp chứng nhận Apostille. Giấy tờ đã có chứng nhận Apostille hợp lệ được sử dụng tại Việt Nam mà không phải thực hiện thêm bất kỳ thủ tục chứng nhận nào. Nếu giấy tờ không lập bằng tiếng Việt thì phải có bản dịch tiếng Việt được công chứng hoặc chứng thực theo quy định của pháp luật Việt Nam.
4. Giấy tờ của Việt Nam để sử dụng tại nước Cộng hòa nhân dân Trung Hoa
Tổng Lãnh sự quán Việt Nam tại Thượng Hải không cấp chứng nhận Apostille. Giấy tờ công của Việt Nam cần được đề nghị cấp chứng nhận Apostille tại Cơ quan cấp chứng nhận Apostille ở trong nước. Thông tin về cơ quan tiếp nhận, hồ sơ, lệ phí và thời hạn giải quyết được đăng tải tại chuyên trang apostille.lanhsuvietnam.gov.vn.
5. Các trường hợp vẫn phải hợp pháp hóa lãnh sự
a) Giấy tờ do viên chức ngoại giao, viên chức lãnh sự lập;
b) Giấy tờ hành chính liên quan trực tiếp đến hoạt động thương mại hoặc hải quan;
c) Giấy tờ do quốc gia, vùng lãnh thổ không có quan hệ áp dụng với Việt Nam cấp, gồm Cộng hòa Liên bang Đức, Cộng hòa Áo, Cộng hòa Séc; Vương quốc Thái Lan cho đến trước ngày 28/02/2027; Greenland thuộc Vương quốc Đan Mạch; Tokelau thuộc Niu Di-lân; và các quốc gia không phải là thành viên Công ước.
6. Giấy tờ đã được hợp pháp hóa lãnh sự trước ngày 11/9/2026
Giấy tờ đã được hợp pháp hóa lãnh sự trước ngày 11/9/2026 tiếp tục có giá trị sử dụng tại Việt Nam. Quý vị không phải làm lại thủ tục dưới hình thức chứng nhận Apostille. Chứng nhận Apostille do cơ quan có thẩm quyền nước ngoài cấp trước ngày 11/9/2026 cũng được tiếp nhận, sử dụng tại Việt Nam.

关于自2026年9月11日起海牙认证（Apostille）替代领事认证的通知
1. 基本信息
越南已加入1961年10月5日《取消外国公文认证要求的公约》（即《海牙公约》或《取消认证公约》）。该公约将于2026年9月11日对越南生效。自该日起，在越南与该公约对彼此均已生效的缔约方之间，一方出具并拟在另一方使用的公文，仅需办理“附加证明书”（Apostille）这一项手续，无需再办理此前的领事认证程序。
“海牙认证”（Apostille）证明了签名的真实性、签署人的身份资格，以及（在适用的情况下）公文上所盖印章或印记的真实性。海牙认证并不证明文件内容的真实性。
2.越南驻上海总领事馆业务调整
自2026年9月11日起，越南驻上海总领事馆将停止受理针对中华人民共和国主管机关签发的公文书的领事认证申请。
3.在中华人民共和国签发并拟在越南使用的文件
请直接向本文件第7部分所列的中华人民共和国主管机关申请签发附加证明书（Apostille）。附有有效附加证明书的公文可在越南使用，无需办理进一步认证。若文件并非以越南语拟定，则须提供经越南法律规定公证或认证的越南语译本。
4.拟在中国使用的越南文书
越南驻上海总领事馆不签发附加证明书（Apostille）。越南公文书须提交至越南指定的有权机关办理附加证明书。有关受理机关、所需材料、费用及办理时限的信息，请访问：apostille.lanhsuvietnam.gov.vn。
5.仍须办理领事认证的情形
a) 由外交或领事官员签署的文件；
b) 直接涉及商业或海关业务的行政文件；
c) 在《公约》尚未对越南生效的国家或领土签发的文件，具体包括：德意志联邦共和国、奥地利共和国和捷克共和国；泰国（至2027年2月28日止）；格陵兰（丹麦王国）；托克劳（新西兰）；以及非《公约》缔约国的国家。
6. 2026年9月11日之前完成认证的文件
凡在2026年9月11日之前通过领事途径完成认证的文件，在越南继续有效，无需重新办理附加证明书（Apostille）手续。由外国主管机关在2026年9月11日之前签发的附加证明书，在越南同样予以认可。

NOTICE on the Application of the Apostille in Place of Consular Legalisation
as from 11 September 2026
1. General information
Viet Nam has acceded to the Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (the Apostille Convention). The Convention enters into force for Viet Nam on 11 September 2026. From that date, public documents executed in one Contracting Party and produced for use in the other require only a single certificate, the Apostille, in place of the previous consular legalisation procedure, in relations between Viet Nam and the Contracting Parties for which the Convention is in force with Viet Nam.
An Apostille certifies the authenticity of the signature, the capacity in which the person signing the document has acted and, where appropriate, the identity of the seal or stamp which the public document bears. An Apostille does not certify the content of the document.
2. Change at Consulate General of Viet Nam in Shanghai
As from 11 September 2026, Consulate General of Viet Nam in Shanghai will cease to accept applications for consular legalisation of public documents issued by the competent authorities of People’s Republic of China.
3. Documents issued in People’s Republic of China for use in Viet Nam
Please apply directly to the competent authority for the issuance of Apostilles of People’s Republic of China indicated in section 7 below. A public document bearing a valid Apostille may be used in Viet Nam without any further certification. Where the document is not drawn up in Vietnamese, a Vietnamese translation, notarised or certified in accordance with the law of Viet Nam, is required.
4. Vietnamese documents for use in People’s Republic of China
Consulate General of Viet Nam in Shanghai does not issue Apostilles. Vietnamese public documents are to be submitted to the competent authority designated by Viet Nam for the issuance of Apostilles. Information on the receiving authority, the required documents, the fees and the processing time is available at: apostille.lanhsuvietnam.gov.vn.
5. Cases in which consular legalisation continues to apply
a) Documents executed by diplomatic or consular agents;
b) Administrative documents dealing directly with commercial or customs operations;
c) Documents issued in a State or territory in respect of which the Convention is not in force with Viet Nam, namely the Federal Republic of Germany, the Republic of Austria and the Czech Republic; the Kingdom of Thailand until 28 February 2027; Greenland (Kingdom of Denmark); Tokelau (New Zealand); and States not party to the Convention.
6. Documents legalised before 11 September 2026
Documents legalised through consular channels before 11 September 2026 remain valid for use in Viet Nam. There is no need to repeat the procedure in the form of an Apostille. Apostilles issued by foreign competent authorities before 11 September 2026 are likewise accepted for use in Viet Nam.
